In a recent court decision, the judges have ruled in favor of R. Senthamizh, allowing his family to receive a community certificate. This decision comes after a long struggle to prove they belong to the Kurumans (ST) community.

The Petition and Its Background

R. Senthamizh filed a request challenging the rejection of his application for a community certificate. He argued that his siblings, R. Suresh Babu and R. Kaviyarasi, had already received certificates confirming they are members of the Kurumans (ST) community. Senthamizh wanted the same recognition for himself and his children, S. Badhrinath and S. Sathyaprakash.

"The person asking for the certificate belongs to 'Kurumans Community' which is classified as a Scheduled Tribe Community."

Previous Rejections and Appeals

At first, the Sub Collector in Tirupattur turned down the application of Senthamizh’s brother. However, an appeal to the State Level Scrutiny Committee reversed this decision, confirming the community status for R. Suresh Babu and his children in 2015. Senthamizh hoped for similar success.

The Court’s Consideration

The court, led by Honourable Mrs. Justice J. Nisha Banu and Honourable Mr. Justice M. Jothiraman, reviewed the case. They noted that the Revenue Divisional Officer (RDO) did not follow proper guidelines in rejecting Senthamizh’s application. The judges emphasized that since the State Level Scrutiny Committee had already confirmed his siblings’ status, the same should apply to Senthamizh.

The Final Decision

The court canceled the rejection order and instructed the Revenue Divisional Officer of Vaniyambadi, Tirupattur District, to issue the community certificate to Senthamizh and his children within four weeks. The decision depends on proof of Senthamizh’s relationship with his brother, R. Suresh Babu.

This judgment is a significant relief for R. Senthamizh and his family, ensuring they are rightfully recognized as members of the Kurumans (ST) community.
