Summary: The Madurai Bench of Madras High Court dismissed Premkumar's appeal against a support payment order favoring his wife and son, Sarika and Dhuruva Dikshit. The court ruled the support amount fair and found no merit in Premkumar's claims.

Background of the Case

In a legal dispute between D. Premkumar and his wife, K. Sarika, the Family Court in Theni had previously ordered Premkumar to pay a monthly support of ₹20,000. This amount was split equally between Sarika and their young son, Dhuruva Dikshit. Additionally, Premkumar was required to cover ₹10,000 in court-related expenses.

Premkumar's Argument

Premkumar, represented by Mr. C. Deepak Kumar, argued that he couldn't afford the support due to his limited salary. He also claimed that Sarika was living separately without a good reason, which should disqualify her from receiving support.

"The Family Court failed to consider that my wife is living separately without a good reason," Premkumar's lawyer stated.

Respondent's Stand

On the other hand, Sarika’s lawyer, Ms. A. Aishwarya Caroline, argued that the Family Court's decision was fair and based on the facts. She emphasized that the court considered all statements before deciding.

"The order is justified and meets the ends of justice," Caroline argued.

Court's Decision

Justice Shamim Ahmed reviewed the case and found no mistakes in the Family Court's judgment. The court emphasized that the support amount wasn't too much given the current economic conditions.

"The provisions aim to prevent homelessness and provide support to a struggling wife," the judge noted.

Summary of Verdict

The court dismissed Premkumar's request to change the decision, instructing the Family Court to proceed with recovering any overdue payments. This decision reinforces the importance of support payments for family members who depend on it and upholds the lower court's judgment as fair and necessary.
