Madras High Court: Mother's Plea for Children's Return Denied

In a recent court case, V. Krishnapriya asked the court to help her get her kids back from their dad. But the judges, Mr. Justice P. Velmurugan and Mr. Justice G. Arul Murugan, decided against her request.

The Request: Mom Wants Her Kids Back

V. Krishnapriya made a request to the court because she wanted her kids, Jayapradha (5 ½ years old) and Varun (4 ½ years old), back with her. She claimed that her husband took the kids to his mom’s house after coming back from Dubai.

"V. Krishnapriya lodged a complaint on 13.09.2025 to the Inspector of Police."

The Judges: Velmurugan and Arul Murugan’s Decision

The judges explained that a special request to bring someone to court is used when someone is being held against their will. Since the dad is the legal guardian, this request doesn't work here.

"Habeas Corpus Petition will not applicable against the father."

What’s Next for Krishnapriya?

The court rejected the request but suggested that Krishnapriya could try other legal ways to resolve the issue.

"V. Krishnapriya is at liberty to work out her remedy before the competent Court."

The court decided not to grant Krishnapriya's request to have her children returned to her, as the father is considered their legal guardian.
