Summary: A family argument over property in Coimbatore is brought to court. Justice S. Sounthar allows the plaintiffs to fix their case and try again.
In Coimbatore, a legal battle over family property has been attracting attention. The case, filed under C.R.P.No.3111 of 2023, is about a lawsuit for dividing property that was originally filed in 2014. The plaintiffs wanted a share of the property that belonged to their late father, Senior Marappa Gounder. But things got tricky when only some family members were included in the lawsuit.
The plaintiffs said that their father’s property should be split equally among his children. However, the defendant, Ramasamy, and his brother, Junior Marappa Gounder, had already divided the property back in 1983. The plaintiffs claimed this division was done without them knowing and asked for a new division.
"The properties are owned by Senior Marappa Gounder, and after his death, his five children should each get 1/5th share."
Before this case, there were other lawsuits in 2012 and 2014. The plaintiffs had agreed to a settlement with Junior Marappa Gounder’s heirs, which led to dropping an earlier lawsuit. But the current defendant, Ramasamy, did not agree to share the property, leading to the new lawsuit.
Justice S. Sounthar pointed out several problems with the current lawsuit. It didn’t include all the necessary people, and it only covered part of the property. The court gave the plaintiffs four weeks to fix these issues by including Junior Marappa Gounder’s heirs and the rest of the property.
"The lawsuit is flawed because it only covers part of the property and doesn’t include everyone who should be involved."
The court’s decision gives the plaintiffs a chance to fix their lawsuit. If they don’t do this within the given time, the lawsuit will be dismissed. This case shows how complicated family property disputes can be and the importance of involving everyone in legal actions.
