Summary: Sanjay Malik, accused of theft, gets bail after a year in jail. The court found the evidence unclear.

Arrest and Charges

Sanjay Malik was arrested on January 31, 2025, in New Delhi. He was accused of being part of a plan to steal from a house where he worked as a domestic helper. The charges included stealing various items and cash, recorded under FIR No. 243/2024 at Police Station C.R. Park.

Evidence and CCTV Footage

The prosecution claimed CCTV footage showed Sanjay Malik and others leaving with bags. However, the footage was unclear. Judge Girish Kathpalia noted, "The footage fails to inspire confidence," as it appeared to be captured by a moving camera, not a stationary CCTV.

"There is no connection between these persons and they are like anyone walking across the street."

Previous Bail and Similar Cases

Sanjay Malik’s lawyer pointed out that a co-accused, Jagbandhu Malik, was granted bail on January 12, 2026, under similar circumstances. The court found inconsistencies in the evidence presented against both accused.

Bail Decision

Judge Girish Kathpalia decided to grant bail, stating there was no strong evidence to keep Sanjay Malik in custody. He was released on a personal bond of Rs. 10,000, with one guarantor.

Future Trial

The court ordered the immediate release of Sanjay Malik but clarified that this decision should not affect the final trial. The case will continue, but for now, Sanjay Malik is free.
