Quick Summary: M. Bharathimohan, who skipped bail and was arrested two years later, has been granted bail again by the Madras High Court with strict rules to follow.
M. Bharathimohan, who lives in Erode, was arrested on September 3, 2025, after a warrant was issued for missing a court date on August 21, 2023. He was facing charges related to kidnapping and child protection laws in a case from 2022. The case was being heard in a special court in Tiruppur.
M. Bharathimohan was initially let out on bail but didn't show up in court because of health problems, according to his lawyer, P. Thinesh. This led to the warrant being issued on August 31, 2023, and his arrest two years later.
"The petitioner was granted bail earlier and was regularly appearing before the court until health issues prevented him," said his lawyer.
The government, represented by lawyer S. Vinoth Kumar, was against granting bail. They argued that M. Bharathimohan's absence delayed the trial, even though others involved in the case were attending. The investigation was finished, and the official charges were ready for trial.
Judge P. Dhanabal of the Madras High Court decided to allow bail, taking into account that the investigation was done and M. Bharathimohan had already spent time in jail. The bail conditions included:
"If any conditions are broken, proper action will be taken according to the law," the court stated.
M. Bharathimohan is now out on bail but must follow strict rules. If he runs away again, a new case can be started under a specific law.
