Summary: The High Court at Madras has ruled in favor of landowners in Ariyalur, increasing the money they receive for land taken by the Tamil Nadu Cements Corporation. This decision affects many appeals and ensures fair payment.
The case is about land being taken in Ariyalur District for a government cement factory under Tamil Nadu Cements Corporation Limited (TANCEM). The Special Tahsildar, who represented the group taking the land, appealed against the payment decided by the Sub Court, Ariyalur.
The process of taking the land started with announcements in early 2000. At first, the Land Acquisition Officer set the land price at Rs.250 per cent based on nearby land sales. But landowners were not happy with this and asked for more money through the court.
"The Sub Court, Ariyalur, by its awards dated 29.04.2017, increased the payment to Rs.1,200 per cent."
The Special Tahsildar argued that this increase was too much. However, after a series of appeals, including a key decision on January 29, 2024, the payment was increased again to Rs.1,500 per cent.
"The market value from Rs.1,200 per cent to Rs.1,500 per cent, directing the payment of the balance within eight weeks."
In an important step, TANCEM decided to pay all affected landowners the same amount of Rs.1,500 per cent, matching the court's decision. This aimed to treat everyone fairly and avoid unfair differences.
"TANCEM itself had passed a resolution—approved by the Government—to pay compensation at the rate of Rs.1,500 per cent."
The High Court, led by Dr. Justice A.D. Maria Clete, ruled against the appeals, confirming the payment of Rs.1,500 per cent without taking away any money for development costs. The court stressed the need for fairness in payments.
"These appeals fail on merits... the market value of the acquired land is fixed at Rs.1,500 per cent."
The judgment is a big win for landowners in Ariyalur, ensuring they get fair payment for their land. The decision shows the court's dedication to fair treatment and sets an example for similar cases in the future.
