Quick Summary: The High Court in Madras has allowed S.T.G. Gangadharan to reopen a case about a property dispute in Ambattur, involving the family members of M. Subburaya Naicker. This decision changes a previous ruling and gives Gangadharan a chance to show new evidence.
Back in 2010, S.T.G. Gangadharan went to the District Munsif Court in Ambattur, arguing that two sale agreements from 2005 were not valid. These agreements were made by a representative of the original property owner, M. Subburaya Naicker, after he passed away in 1997.
Gangadharan bought the property on August 3, 2005, from Naicker's family members. However, in 2010, others claimed they had rights to the property based on those disputed sale agreements. Gangadharan argued the agreements were not valid since they were made after Naicker's death.
Gangadharan wanted to reopen the case so he could show documents from a 2017 lawsuit involving Naicker’s family members. He forgot about these documents because he was sick and didn't show them earlier. These documents could be important in proving he owns the property.
Judge S. Sounthar of the High Court noted that the issue about Naicker’s family members had been brought up since 2015. However, the documents from the 2017 case were only completed in 2023, so they weren't available during the original trial.
"The Court feels an opportunity shall be given to the petitioner to recall PW.1 for the purpose of marking the document relating to litigation," said Judge S. Sounthar.
The High Court has canceled the previous order from November 24, 2025, allowing Gangadharan to present the new evidence. This means the case will be reopened, and the new documents will be considered.
The court has decided to give Gangadharan another chance to present new evidence that could affect the outcome of the property dispute. This means the case will be looked at again with the new information.
