Summary: Recently, Judge Tirumala Devi Eada decided not to stop the legal process in a fraud case involving illegal property deals. The person who asked for this, B Ganesh Rao, who faces serious accusations, must work with the ongoing investigation.
This case is about a request made by B Ganesh Rao, who is accused number 7 in a fraud case. The case is connected to Crime No. 06 of 2022, recorded at the Central Crime Station in Hyderabad. The accusations include serious crimes under the Indian Penal Code (IPC) like Section 420 (cheating), Section 465 (making fake documents), Section 467 (making fake important documents), and Section 471 (using fake documents), along with Section 34 (crimes done together with others).
B Ganesh Rao's lawyer, Sri L. Anand, argued that most of the accusations have punishments of less than seven years, except for Section 467. He said that the claims against Ganesh Rao don't justify using Section 467. So, he asked the court to tell the police to use a simpler procedure under Section 35(3) of the BNSS, which used to be known as Section 41-A of the Cr.P.C.
The government's lawyer, Sri Jithender Rao Veeramalla, disagreed with the request. He mentioned specific accusations against B Ganesh Rao and another accused, B Nageswar Rao, saying they illegally made a mortgage agreement to misuse family property. The prosecution stressed the seriousness of the accusations, justifying the need for a complete investigation.
Judge Tirumala Devi Eada looked over the case and decided that the investigation should go on. She noted that since one of the accusations involves a punishment of more than seven years, using a simpler procedure was not right.
"The investigation is still in progress and the crimes alleged fall under Sections 420, 465, 467, 471 read with Section 34 of IPC against the petitioner herein along with other accused."
The court instructed the police to finish the investigation strictly according to the law. B Ganesh Rao must help with the investigation by providing necessary information and documents.
The court's decision shows how serious the accusations are and the importance of a complete investigation. The case will continue, with B Ganesh Rao expected to follow all legal requirements.
