Here's a breakdown of a recent court case where three final year CA students tried to get a criminal case against them dismissed. They were accused of having MDMA, but the court decided the case should continue.
Three CA students, Bashapaga Pavan Raj, Mohammed Aslam Hussain, and Sanga Prem Sai, found themselves in legal trouble. They were accused of having 1.14 grams of MDMA. The police caught them at Golden Cave Restaurant & Bar in Hyderabad.
"The police seized 1.14 grams of MDMA from the possession of Bashapaga Pavan Raj, Mohammed Aslam Hussain, and Sanga Prem Sai."
The students' lawyer, Sri Thakur Rishab Dev Singh, argued that the accusations were untrue. He said they had CCTV footage showing the police took them from their homes and faked the evidence.
"They were picked up from their residence and a false report has been conducted by the police."
On the other side, the Additional Public Prosecutor, Sri Jithender Rao Veeramalla, insisted that the investigation was still in progress. He argued that the illegal substance was indeed found with the students.
Justice Tirumala Devi Eada reviewed the case and decided not to dismiss it. She referred to a past Supreme Court decision, explaining that dismissing a case like this should be rare and only in special situations. Since the accusations seemed to have some basis, the case was allowed to continue.
"The allegations made in the FIR do prima facie point out an offence... Hence, it is not a fit case to quash proceedings."
The court directed the police to finish their investigation quickly and asked Bashapaga Pavan Raj, Mohammed Aslam Hussain, and Sanga Prem Sai to cooperate. For now, the case against the students is still ongoing, and the investigation will continue.
"The Criminal Petition is disposed of directing the police concerned to conclude the investigation at the earliest."
This case shows how serious drug-related charges can be and the difficulties of getting such cases dismissed in court.
