In a recent decision, the High Court of Bombay at Goa dealt with a case about unauthorized building activities in a beautiful area of Goa. The court, led by Judges Bharati Dangre and Nivedita P. Mehta, made an important decision to stop these activities, stressing the need to follow the rules and protect the environment.

The People Involved and the Case

Anand Esvonta Achorencar and Pradip Keshav Volvoikar, the people who brought the case to court, challenged the building activities started by Tarun Radhakrishin Tahliani. They claimed that the building went against environmental rules and zoning regulations. They argued that the permissions given for these activities were not only illegal but also harmful to the natural surroundings.

The Legal Dispute

The case focused on the change and building on a piece of land in Survey No.292/1-L of Village Salvador do Mundo. The petitioners argued that the permissions were obtained dishonestly and without proper consultation with the Goa State Biodiversity Board and other authorities.

"The permissions given are against RPG-2021 and go against the order dated 04.02.2015 of the Supreme Court," stated Anand Esvonta Achorencar and Pradip Keshav Volvoikar.

Court's Findings

The court agreed with the claims made by the petitioners. It noted that the Technical Clearance given on 03.02.2023 for building was not in line with the zoning requirements. The court emphasized that any development must follow the Regional Plan 2021 guidelines, which were not followed in this case.

Stopping the Building

In response to the findings, the court ordered a stop to the ongoing building. The judges pointed out that the area in question was marked as a "Settlement Zone," and any building there should follow the specified rules.

"We order the immediate stop of all building activities that do not follow the Regional Plan 2021," the court ordered.

The Importance of Following Rules

This decision serves as a reminder of the importance of following legal and environmental rules. The court highlighted that any departure from the approved plans could lead to serious consequences, not just legally but also for the environment.

Verdict Summary

The case of Anand Esvonta Achorencar vs. State of Goa shows the court's role in keeping a balance between development and protecting the environment. By making sure that zoning laws are strictly followed, the court has shown its dedication to protecting Goa's natural beauty.
