The Nomination Rejection

Mr. Rajesh Kumar, who was running for the Jai Mahabharath Party, turned in his nomination on the last day possible, October 21, 2025. However, the Election Officer turned it down the next day, saying it was not done correctly.

"The Election Officer checked the nomination... and found the nomination to be not done correctly."

Person's Argument

The lawyer for the person who filed the request, Ms. S.A.V. Ratnam, argued that the rejection broke the Representation of People Act, 1951. She insisted that Mr. Rajesh Kumar should have been given a chance to fix any problems before it was turned down.

"Turning down the nomination was against the rules... a chance should have been given to fix mistakes."

Other Side's Defense

On the other side, Mr. Avinash Desai, representing the other party, argued that the request was not valid. According to him, any challenge to an election must be made through an election petition, as per Sections 80 and 100 of the Representation of People Act, 1951.

Court's Decision

The court referred to a Supreme Court decision stating that arguments over nominations should be addressed through election petitions, not through these types of requests. Therefore, the court found no reason to change the Election Officer's decision.

"The only option now available... would be to argue through an election petition."

Verdict

The court dismissed the request, stating it didn't have enough reason. Mr. Rajesh Kumar was advised to file an election petition if he wanted to challenge the nomination rejection further.

"The request lacks enough reason and is therefore rejected."

This case shows how important it is to follow the right steps when dealing with election-related issues.
