Quick Summary: An Upper Divisional Clerk, suspended for alleged misuse of funds, was cleared of charges. Yet, he's still not back at work, and time is running out as he nears retirement.
Back in October 2020, our petitioner, Ramesh Kumar, an Upper Divisional Clerk, was suspended. Why? He was accused of being part of a group that misused funds from the Society where he worked. Fast forward to an internal investigation in January 2025, and guess what? The charges against Ramesh Kumar were not proven. Despite this, he's still out of work.
"The charges leveled against Ramesh Kumar were not proven."
Ramesh Kumar took his case to court, asking for help under Article 226 of the Constitution. He wanted the court to declare the continued suspension as unfair and to order his return to work. His lawyer, Sri K. Muralidhar Reddy, argued that the suspension should have been reviewed every six months, as per government rules.
The Government's lawyer said Ramesh Kumar still had some responsibility to the Society, which is why he wasn't back at work. However, they agreed to review the suspension order.
Judge Pulla Karthik listened to both sides and decided that the suspension order should indeed be reviewed. He directed the respondents to consider the internal investigation report and make a decision within two weeks.
"This Court deems it appropriate to direct the respondents to review Ramesh Kumar’s suspension order."
With the court's decision, the responsibility now lies with the respondents to act quickly. Ramesh Kumar, who is set to retire soon, hopes for a quick resolution so he can end his career on a positive note.
