
In a recent decision from the High Court of Delhi, a disagreement about an unsigned Written Statement took a new turn. The court, led by Judge Girish Kathpalia, made an important decision on December 12, 2025.
The case started with a decision from March 10, 2025. The trial court had stopped Sudhir Kumar Windlass, the wife of Col Ajay Ahlawat, from presenting evidence. Why? Because the Written Statement wasn't signed by her, only by her husband, Col Ajay Ahlawat. This was a problem because the trial court thought an unsigned statement meant she couldn't present evidence.
"The Written Statement was unsigned, so Sudhir Kumar Windlass cannot be allowed to present evidence."
During the hearing, lawyers from both sides agreed to solve the issue peacefully. Col Ajay Ahlawat's lawyer mentioned that the statement had signatures from Col Ajay Ahlawat and was accepted for all involved at first. They only wanted to call one witness for Sudhir Kumar Windlass.
Judge Kathpalia decided to cancel the previous order. The court allowed Sudhir Kumar Windlass to present her witness on the next scheduled date, December 19, 2025. If that day didn't work, a new date would be set.
"Sudhir Kumar Windlass shall be allowed to examine one witness; that on the date already fixed i.e., 19.12.2025..."
The court stressed the need for a quick trial. The trial court was told to handle the case as fast as possible, making sure any delays were kept to a minimum.
This decision shows the court's ability to be flexible and willing to change when both sides agree. It also highlights the importance of having the right paperwork in legal matters.
