The Appeal and Its Grounds

Anand Versha and another person who appealed disagreed with the trial court's decision, arguing that the Relinquishment Deed depended on a family agreement to rebuild the property. They claimed that later unregistered sale documents, including a Will, gave them rights to the property.

Relinquishment Deed Validity

The court emphasized that the Relinquishment Deed was an officially recorded document and could not be contested by spoken agreements. Justice Pushkarna noted:

"No spoken evidence can be used against the said registered written document."

Unregistered Sale Documents

Anand Versha and the other person who appealed relied on unregistered documents to claim ownership. However, the court ruled these documents invalid for transferring property rights, as they were not officially recorded:

"Such unregistered documents cannot be held to be valid tools for transfer of ownership."

Will and Its Execution

The appellants' claim based on a Will was also dismissed. The court pointed out that the Will was unregistered and not proven according to legal standards:

"The validity of the said Will cannot be assumed and accordingly, the same had to be proven by the appellants, in accordance with the law."
