Delhi HC: MCD Must Rehear Property Case After Missed Meetings

On December 11, 2025, the Delhi High Court decided that Amit Saxena should get another chance to present his case against the Municipal Corporation of Delhi (MCD) about his properties in Hari Nagar. Here's what happened.

The Dispute Over Property Orders

Amit Saxena filed a request to cancel an order from September 30, 2024, by the MCD about his properties in G Block, Hari Nagar, New Delhi. He argued that the MCD didn't give him a fair chance to show that his property wasn't unauthorized.

"The petitioner was not granted proper hearing by the MCD," said Amit Saxena's lawyer.

Missed Hearings and Quick Decisions

The MCD issued a notice for a meeting on July 30, 2024. Saxena attended on August 8 but needed more time to gather documents. The meeting was postponed to August 21, but it didn't happen. It was rescheduled to September 18, but then suddenly moved up to September 10. Saxena asked for more time again, but the MCD didn't agree.

Legal Arguments

Saxena's lawyers argued that the MCD's actions were unfair because Saxena didn't get a fair chance to present his case. They also said the MCD didn't follow Supreme Court rules on demolitions.

MCD's Stand

The MCD argued that Saxena could have challenged the demolition order through other legal ways. They also explained that a key official had retired, which affected how the case was handled.

Court's Decision

Justice Mini Pushkarna decided that the case should go back to the MCD for a fresh look. Saxena can now present all his documents, and the MCD must give him a proper hearing. The court canceled the previous orders from September 2024 and February 2025.

"The matter is remanded back to the MCD for fresh consideration," said Justice Pushkarna.

What's Next?

Saxena must appear before the MCD's Executive Engineer on December 23, 2025, to start the new process. The MCD has three months to complete this review.

This decision means Amit Saxena gets another shot at proving his case, ensuring fair treatment and proper procedures are followed.
