On December 1, 2025, the Delhi High Court made an important decision about the Aerosky Deluxe Hotel in Dwarka, New Delhi. Here's what happened.
On July 8, 2025, Pradeep Kumar Goyal, who owns the Aerosky Deluxe Hotel, got a notice from the Deputy Commissioner of the Najafgarh Zone, Municipal Corporation of Delhi (MCD). The notice, issued under a section of the Delhi Municipal Corporation Act, 1957, told the hotel to stop using the building in the wrong way and to follow the Master Plan for Delhi 2021.
Even though the hotel was running as a "bed and breakfast," which is usually allowed, the property was sealed on July 24, 2025. The MCD said the sealing was done because of orders from a Monitoring Committee, which referred to a Supreme Court decision in the M.C. Mehta case.
"The property in question was sealed following instructions from the Monitoring Committee."
The Supreme Court had earlier created a Monitoring Committee to deal with businesses that were not allowed in residential areas. This was part of the M.C. Mehta case, aiming to protect Delhi's residential neighborhoods.
The Supreme Court, noticing there were many requests to unseal properties, set up a Judicial Committee. This committee, made up of retired judges, was given the job of looking into these cases.
"A Judicial Committee of two respected Judges: Justice Pradeep Nandrajog and Justice G.S. Sistani."
Justice Mini Pushkarna, who was in charge of the case, told Pradeep Kumar Goyal to present his situation to this Judicial Committee. This committee can make decisions about sealing and unsealing, regularization, fees, and more.
The court decided to close the case, giving Goyal the chance to find a solution through the newly formed Judicial Committee.
