
Two brothers, Nishant and Nitin Haribhau Yadav, have been denied bail by the Bombay High Court in Aurangabad. They've been in jail for 11 years for a double murder case. Here's what happened.
Nishant and Nitin Yadav were found guilty of killing Ashwini and Ashok. They were charged with murder and received two life sentences.
"Both the applicants have been convicted under Section 302 read with Section 34 of the Indian Penal Code and sentenced to suffer double life imprisonment."
The Yadav brothers asked for bail, arguing that their long time in jail should allow for their sentence to be paused. Their lawyers pointed to several past cases where people were given bail after being in jail for a long time.
Judges Sandipkumar C. More and Mehroz K. Pathan decided against the bail request on December 24, 2025. They said that just being in jail for a long time isn't enough to get bail, especially in serious cases like murder.
"The invocation of power under Section 389 of the Cr.P.C. cannot be exercised without adverting to the merits of the case."
The prosecution mentioned recent decisions from the Supreme Court, saying that bail in murder cases requires looking at how serious the crime is, not just how long someone has been in jail.
Given the seriousness of the crime, the court decided that the Yadav brothers must stay in jail while their appeal is pending. The applications for bail were rejected.
