Quick Summary: On November 26, 2025, the Bombay High Court, led by Justice Milind N. Jadhav, turned down several requests to stop the tearing down of illegal buildings near Kandivali Railway Station, Mumbai. The people who filed the requests were fined for not sharing all the facts.
Eight people, including Ganpat Shankar Chougule, asked the court to stop the Municipal Corporation of Greater Mumbai (MCGM) from demolishing their buildings, saying they had been there for a long time.
The buildings have been around since 1998. The land belongs to Nemi Krishna Cooperative Housing Society, near Kandivali Railway Station. Ganpat Shankar Chougule and the others said they had the right to keep their buildings because of documents like census certificates and repair permissions.
"The land on which the 8 buildings of Ganpat Shankar Chougule and the other people before me are situated belongs to Nemi Krishna Co-operative Housing Society."
From 1999 to 2024, these buildings were involved in many court cases. The Saibaba Mitra Mandal, representing the first people living there, had already lost a Supreme Court case about these buildings. Even so, Ganpat Shankar Chougule and the new people involved said they were not part of the earlier case.
Justice Jadhav found Ganpat Shankar Chougule and the others guilty of hiding past court cases. The court said the buildings were illegal and had already been taken down in 1999. The claims that the buildings were in different places were found to be false.
"These are buildings that are illegal and were put up without permission outside the Railway Station."
The court supported the MCGM's decision to demolish the buildings. It fined Ganpat Shankar Chougule and the others for their actions. They were ordered to pay fines to the Kirtikar Law Library, Mumbai.
"All decisions questioned in the 8 appeal requests are confirmed and supported."
The court decided that the buildings were illegal and could be demolished. It also fined the people who tried to stop the demolition for their misleading actions.
