
In a recent decision, Judge Tirumala Devi Eada looked at a request from seven people accused in a case at Chityal Police Station, Nalgonda District. The court told the police to follow the correct rules during their investigation.
The request, numbered 13603 of 2025, was made under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). The people asking for help, called accused Nos. 1 to 7, wanted to stop the legal process related to Crime No. 283 of 2025. They were facing charges under Sections 318(4), 324(4), and 351(2) read with 3(5) of BNSS, which involve crimes that could lead to less than seven years in jail.
Sri Ravi Chandra Bejjaram, who spoke for the accused, asked the court to tell the police to follow Section 35(3) of BNSS. The Additional Public Prosecutor, Sri Jitender Rao Veeramalla, agreed that the police should give a notice under the same section because of the type of crimes involved.
Judge Eada looked at the case and chose not to discuss its details. Instead, she told the accused to meet with the Investigating Officer by November 13, 2025. The officer must follow the rules in Section 35(3) of BNSS and follow guidelines from the Supreme Court's decision in Arnesh Kumar v. State of Bihar.
"The people accused should share their side of the story and work with the Investigating Officer whenever needed."
The court stressed that the accused must help by giving necessary information and documents. The investigation should continue legally, taking into account the defense provided by the accused.
The request has been concluded, and any other pending requests are closed. Judge Tirumala Devi Eada's order ensures that the investigation follows legal rules, protecting the rights of the accused while allowing the police to do their job properly.
