Nagpur Court: MADC Ordered to Refund ₹10.29 Crores to Wipro

Wipro Limited had a long-standing disagreement with the Maharashtra Airport Development Company (MADC) over a land deal at MIHAN SEZ in Nagpur. After years of back-and-forth, the court has finally ordered MADC to pay back Wipro a huge sum of ₹10.29 crores.

The Land Deal That Didn't Land

In 2007, MADC promised Wipro 117 acres of land to build an IT park. Wipro paid 20% of the money upfront, but the deal fell apart because MADC didn't provide basic things like roads and water.

"The necessary infrastructural facilities at MIHAN project were not established as promised."

A Decade of Disputes

For years, Wipro kept asking for their money back or a smaller piece of land because they didn't get what was promised. MADC, however, refused and said Wipro didn't keep their side of the deal.

"There is total failure on your part to comply with any of the terms of the Agreement."

Court's Verdict: Refund Without Interest

The court found nothing in the agreement that allowed MADC to keep Wipro's upfront payment. It decided that since MADC could sell the land at higher prices now, they should pay back Wipro, but without any extra money for interest.

"Ends of justice would meet if the advance amount is directed to be refunded to the Petitioner without any interest."

Lessons Learned

This case shows how important it is to have clear agreements and for public organizations to act fairly. MADC's failure to provide the promised infrastructure led to this long legal fight.

The court decided that MADC must refund Wipro the ₹10.29 crores they paid in advance.
