On February 23, 2009, a tragic accident occurred. The deceased, driving a Toyota Qualis, lost control, causing the vehicle to flip over. This accident happened on the Sankarankoil-Kovilpatti Main Road, resulting in serious injuries and ultimately the driver's death. The vehicle was insured by The New India Assurance Company.

The Claim for Compensation

Annalakshmi, the wife of the deceased, filed a claim for compensation of Rs.3,93,500, stating that her husband was the family's main source of income. She argued that his death left the family in financial trouble. The claim was initially accepted by the Motor Accident Claims Tribunal, which awarded her the requested amount plus interest.

Insurance Company's Appeal

The New India Assurance Company, however, appealed the decision. Represented by Mr. J.S. Murali, they argued that the deceased was driving carelessly and was not a third party. According to them, since he borrowed the vehicle from his brother, the vehicle's owner, he couldn't claim compensation as he was basically in the owner's position.

Justice R. Poornima presided over the appeal. After reviewing the evidence, the court found that the deceased was indeed responsible for the accident. Final Verdict

The court canceled the Tribunal's previous order, dismissing Annalakshmi's claim. The insurance company was entitled to get back any amounts they had already paid.
