Summary: Mrs. Janagam's request to increase her land compensation was rejected by the Madras High Court. She must now take her case to a District Court.
Mrs. Janagam owned land in Cuddalore that was taken over for a national highway project. On October 6, 2023, the District Collector, acting as a decision-maker, decided on the compensation amount. Mrs. Janagam felt it wasn't enough and went to court.
The case was heard by Judge Senthilkumar Ramamoorthy on January 20, 2026. Mrs. Janagam wanted the court to cancel the previous decision and increase her compensation. Her lawyer, Mr. R. Chakkaravarthy, argued that the compensation was unfair.
The government's lawyer, Mr. P. Sathish, pointed out that the Arbitration and Conciliation Act of 1996 applied to this case. According to this law, Mrs. Janagam should have challenged the decision within a specific time frame, which she didn't.
"The petitioner cannot overcome the limitation period prescribed therein by filing a writ petition."
Judge Ramamoorthy decided not to consider Mrs. Janagam's petition. He suggested that she could still approach a District Court for her issue.
"I am not inclined to entertain this writ petition."
While the High Court won't help, Mrs. Janagam can still take her case to a District Court. She hopes to get a better compensation through this route.
