Arunkumar was driving a TATA Indigo with his friends Nishadh and Ashwath when they crashed into a Swaraj Mazda truck. Arunkumar and Nishadh died in the accident, and Ashwath was seriously hurt. The Motor Accident Claims Tribunal at Krishnagiri decided that the crash was caused by the careless driving of the Swaraj Mazda truck and awarded compensation to the families of the victims.
Shri Ram General Insurance Co. Ltd., which covered the Swaraj Mazda truck, challenged the decision. They argued that the police report blamed Arunkumar for the accident and said the compensation amount was too high. However, the court found the police report unreliable because the person who filed it said he only signed where the police told him to, without knowing what it said.
The court, led by Judges C.V. Karthikeyan and K. Kumaresh Babu, carefully looked at all the evidence. They confirmed that the accident happened because the Swaraj Mazda truck suddenly and carelessly entered the highway, not because of how the TATA Indigo was driven. The court rejected the insurance company's appeal, confirming they had to pay the compensation.
