Smt. Ursula Ignatius and Smt. Nallavijayalakshmi were upset because they couldn't get their sale agreements approved for some flats in a building called "Mecqueryklassik" in Quthbullapur, Hyderabad. The flats are partly finished and located on the fourth and fifth floors, with some parking space included.
The issue came up because the land where these flats are built was marked as restricted property under a specific rule. This was based on several official announcements, including one from 2005.
"Unhappy with the action...in not accepting, approving, and releasing the sale agreements," the petitioners turned to the court for help.
Smt. S. Sravanthi, the Assistant Government Lawyer, argued that Smt. Ursula Ignatius and Smt. Nallavijayalakshmi hadn't even submitted their documents to the registration office before coming to court. She assured that if they did, the authorities would follow the correct steps under another specific rule.
Judge K. Sarath decided that the registration office should accept the documents if Smt. Ursula Ignatius and Smt. Nallavijayalakshmi follow all the rules. However, the office can still refuse if there are valid reasons, which must be explained to them.
"This Court has not given any opinion on the merits of the case," Judge Sarath clarified, meaning he didn't decide if the petitioners are definitely allowed to register the documents, only that they should be allowed to try.
Smt. Ursula Ignatius and Smt. Nallavijayalakshmi now have the chance to present their documents for registration. If the registration office has any objections, they must explain why. The case doesn't have any additional costs, and any other pending requests are now closed.
In summary, the court has allowed the petitioners to attempt to register their flats, provided they meet all the necessary requirements.
