
Here's a story about a legal fight between Sangeeta and Hitesh Kumar over a house in Delhi. The court had to decide who really owned the house after they got divorced.
Sangeeta and Hitesh got married on September 11, 2000, and had a son in 2006. They lived together until 2007. During their marriage, Hitesh bought a house in Uttam Nagar, Delhi, in 2005. However, they got divorced in 2010, and Sangeeta continued living in the house.
Hitesh wanted his house back and asked Sangeeta to move out in 2010. When she didn't leave, he went to court in 2014 to get the house back and ask for money because she was living there without his permission.
The court, led by Judge Mini Pushkarna, looked into the case. Hitesh had bought the house with an official document and a loan from a cooperative society. Although Sangeeta said she helped pay for the house, the court found no real proof that they both owned it.
"There is a belief that an official document is properly made," the court noted, highlighting that the house legally belonged to Hitesh.
Sangeeta argued that the house was her family home, which meant she had the right to stay there. However, the court said that while women have the right to live in a family home during marriage, this doesn't mean they own it after divorce.
At first, the trial court decided Hitesh should get money for damages, but this decision was changed. The court recognized that Sangeeta had paid some of the loan installments, acknowledging her financial help during the marriage.
The court confirmed that Hitesh had the right to the house but canceled the money he was supposed to get for damages. Sangeeta was asked to move out of the house, but without having to pay any penalties.
