The Delhi High Court has decided that a disagreement between Shri Bhagwan Das Smriti Trust and Millenium Education Management Pvt. Ltd. will be settled through a process where an independent person helps decide the outcome. Background of the Case

Shri Bhagwan Das Smriti Trust filed a request under a section of the Arbitration and Conciliation Act, 1996. They wanted to stop Millenium Education Management from doing anything based on a letter they sent on September 23, 2025, that ended their agreement. The Trust wanted to protect its rights under a deal they made on June 1, 2017.

"Stop Millenium Education Management Pvt. Ltd. from taking any actions against Shri Bhagwan Das Smriti Trust," the request stated.

Agreement to Arbitrate

Both sides agreed that the disagreement should be settled by an independent person instead of going to court. The original 2017 agreement already included rules for settling disagreements this way.

  • Clause 19: Disagreements will be settled by an independent person in New Delhi, and their decision will be final.
  • Clause 20: Only the courts in New Delhi can handle related issues.

Appointment of an Arbitrator

Justice Harish Vaidyanathan Shankar appointed Hon’ble Mr. Justice Brijesh Sethi as the person to settle the disagreement. The court stressed the need to start this process quickly to avoid delays.

"It would be fair to appoint an Arbitrator," the court stated.

Financial Details

The disagreement involves a value of about Rs. 2.5 crores. Both sides agreed to split the costs of the arbitration process equally.

The Arbitrator, Mr. Justice Brijesh Sethi, will begin the arbitration process after providing necessary information. Both sides can raise concerns and present their arguments during this process.
