Quick Summary:
Rohit Mohan Pugalia wants to move a domestic violence case to the Family Court so it can be heard along with ongoing divorce and family matters. Judge Kamal Khata agreed to the transfer to save time and effort.

The Request for Transfer

Rohit Mohan Pugalia, the person asking, wanted the court to move a domestic violence case (DV case No.62/DV/2024) from the local court in Bandra to the Family Court. He wants it combined with two other cases: a divorce and a family matter. This way, all related issues can be sorted out together.

Overlapping Issues

Rohit’s lawyer, Mr. Shah, said that the domestic violence case and the divorce case have similar issues. Both involve who gets to look after their young daughter, Rhyah, and other related matters. Handling them together in the Family Court would prevent different decisions and save time and money.

"Combining the two cases would also avoid doing the same work twice, save court time, and cut down on unnecessary costs."

Respondent’s Stand

Purvi Rohit Pugalia, the other person in the case, didn’t file a reply but didn’t agree with the transfer. Her lawyer, Mr. Siram, mentioned a previous case, Anurag Agarwal vs. Poonam Agarwal, saying that the transfer wasn't needed. However, the judge found that case was different from this one.

Judge’s Decision

Judge Kamal Khata decided that moving the DV case to the Family Court was the best option. The judge noted that both courts are close by, so it wouldn’t be a hassle for either side. Plus, the Family Court can handle all the issues together.

"The Family Court matter cannot be moved to the local court; so, the right thing to do is to move the DV case to the Family Court."

Legal Principles

The judge talked about several past cases, saying that when multiple cases involve the same people and similar issues, it’s better to have them heard together. This avoids different decisions and is more efficient.

Summary of the Verdict

The court agreed to Rohit’s request to move the DV case to the Family Court. The Family Court will now handle all related matters, aiming to sort them out more effectively and quickly.
