Quick Summary: The Bombay High Court decided against Innovations Garment Pvt. Ltd., saying they couldn't change a previous decision. The company accused Bhavesh Ramjibhai Gada and others of using their brand without permission, but the court didn't find their claims convincing.
Innovations Garment Pvt. Ltd., a company in Mumbai, sued Bhavesh Ramjibhai Gada and others for supposedly using their brand name without permission. The company said they owned the brand name and wanted the court to stop others from using it without their okay.
On May 7, 2024, the court temporarily stopped Bhavesh Ramjibhai Gada and others from using the brand name in their business. Innovations Garment said this was needed to protect their brand from being copied.
Bhavesh Ramjibhai Gada, with help from Mr. Vashi, said that Innovations Garment had tried to sue them before, but it didn't work out. They said the company didn't tell the court about this earlier case and made it seem like the situation was more urgent than it really was.
"The company made it look like an emergency," said Mr. Vashi, pointing out mistakes in Innovations Garment's story.
Dr. Tulzapurkar, speaking for Innovations Garment, disagreed with the claims of hiding information. He said the old case didn't matter and that Bhavesh Ramjibhai Gada and others were indeed using their brand name without permission.
"The defendants are clearly using our brand," Dr. Tulzapurkar said, stressing that the brand name was rightfully theirs.
Judge Arif S. Doctor decided on November 6, 2025, that Innovations Garment did not hide important information. The court saw no reason to change the temporary order, as Bhavesh Ramjibhai Gada and others couldn't prove that Innovations Garment had been dishonest.
The court kept the temporary order in place, which means Innovations Garment can continue to protect its brand name. Bhavesh Ramjibhai Gada and others' request to cancel the order was denied, confirming Innovations Garment’s ownership of the brand name.
